FREEDOM OF INFORMATION LAWS IN TRINIDAD AND TOBAGO
In Trinidad and Tobago the case law
is developing around
the Freedom of Information Act (FOIA).
Mr Kulraj Kamta pioneered litigation in this area of law, firstly before Justice Christopher Hamel Smith, and then, other contemporary Judges.
Mr Kamta is recognized as the pioneer in this area of law in Government circles and amongst Lawyers.
Not all Judges and public officials were equally receptive towards application to Judicial review under the FOIA.
Some Government officials were resentful. It was felt that Lawyers were intrusive to the affairs of the Government.
Both judicial and Government official attitudes have changed radically since then. Now the citizen’s rights under the FOIA
have been working and needs some analysis. An attempt needs being made of the case law development under the FOIA.
